Terms and Conditions

These Terms and Conditions (Conditions) set out the basis on which Dakhla Kitesurf World (as defined below) will provide accommodation and other products and services at the hotel to Customers and Guests (as defined below). By making a Booking (as defined below) the Customer agrees to comply with these Conditions.

1. Interpretation

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Arrival Date” means the date on which the Customer’s stay at the hotel is due to commence, as per the Booking Details
“Booking” means the reservation by the Customer of accommodation and any other products and services detailed in the Booking which is accepted by Dakhla Kitesurf World.
“Booking Details” means the details of the Booking including the number of Guests, the number of rooms/ bungalows required, the duration of the Guests’ stay and any other products and/or services to be included in the Booking
“Charges” means the charges payable by the Customer in accordance with the Booking
“Contract” means the contract between the Customer and Dakhla Kitesurf World relating to the Booking
“Customer” means person who makes the Booking
 “Guests” means the Customer and any third parties they invite to the Hotel/ Kite camp pertaining to the Booking
“Dakhla Kitesurf World” means ESCADA BAIE S.A.R.L. (registered company number 6387) which operates the hotel Dakhla Kitesurf World.
“Dakhla Kitesurf World” means the hotel owned and operated by ESCADA BAIE and which its location is at PK 25 Dakhla.

2. Booking

2.1 Customers can request Bookings via Dakhla Kitesurf World’s website, OTAs or other booking channels, or by contacting the hotel’s staff.
2.2 When requesting Bookings, Customers will be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.
2.3 No request for a Booking should be deemed to be accepted unless and until Dakhla Kitesurf World
confirms its acceptance, at which point the Contract will come into effect.
2.4 Any request to change the dates or length of stay or add products and/or services will be subject to availability.

3. Fees and payment

3.1 The Charges will be as quoted by Dakhla Kitesurf World and/or third parties upon the Customer’s request for a Booking.
3.2 Customers will be informed of the amount of the Additional Charges such as Tourism Tax, Kitesurfing lessons, excursions activities and/or drinks before they are incurred.
3.3 Bookings will be subject to the Customer:
making a deposit of 50% of the Charges in full in advance. Any Additional Charges can be paid at the hotel.
3.4 The remaining balance must be paid at check in or 48 hours prior to check out. Any Additional Charges must be paid either as they are incurred or upon the Customer checking out at the Hotel.
3.5 Your booking is confirmed once payment of 50% of the full amount is processed. Secured Payment with major credit cards can be made at Dakhla Kitesurf World’s website https://dakhlakiteworld.ma

4. Cancellations

4.1 The customer can cancel a booking at any time by giving a notice in writing to Dakhla Kitesurf World. Please note that cancellations are free of charge 7 days prior to arrival date; otherwise, fees equivalent to 50% of the total booking amount will be applied when the customer cancels less than 7 days before arrival date or in case of no-show.
However, the cancellation fees mentioned above will not apply in case of force majeure. You may be eligible for a refund in the event of cancellation due to unforeseen circumstances beyond your control. The circumstances of our Force Majeure Policy are: death of a close relative, serious and / or contagious illness, hospitalization, very serious injury, closure of airports and roads caused by natural disasters. Before cancelling your reservation, please check that your situation matches the circumstances mentioned above and that you are able to provide the necessary supporting documents.
4.2 Dakhla Kitesurf World may at any time cancel a Booking due to circumstances outside its control in which case Dakhla Kitesurf World will pay the Customer a full refund of the booking fees paid.

5. Check-in and ckeck-out

5.1 Check-in time at the Hotel is from 14:00 hrs. Check-in prior to 14:00 hrs may be arranged subject to availability at the hotel.
Moroccan Couples:
kindly note that n the case of a Moroccan couple or if one of the persons is of Moroccan nationality, you will be asked to show the marriage certificate upon check-in.
5.2 Check-out time at the Hotel booked is 12:00 hrs. Later check-out times may be possible by prior arrangement with an additional charge and subject to availability.

6. Hotel's Rules

6.1 A valid photo identification in the form of Passport or C.I.N is required at check-in.
6.2 Customers are required to conduct themselves and ensure that their Guests conduct themselves in a responsible manner at the Hotel and must not act in any way which may disturb other guests. Failure to adhere to this requirement may result in Guests being asked to leave the Hotel in which event all Charges and Additional Charges shall become immediately payable by the Guest.
6.3 The Customer will be responsible for any loss or damage caused at the Hotel by Guests or visitor of the Guest, including the Kitesurf Center which ……. are detailed in the Kitesurf Center’s terms (link ). The Guest may be liable for Dakhla Kitesurf World’s reasonable cost of repairing, cleaning or replacing any property of the hotel which is damaged, soiled or lost by a Guest.

7. The Kitesurf Center

7.1 The DKW Kitesurf Center is open every day from 8h:00 to 22h:00. Kiteboarding is not permitted outside the range of operating business hours.
7.2 Daily rentals must be returned before 22h:00 in the evening. Kiteborading/ Kitesurfing Gear Rentals: Participants can’t rent kiteboarding gear if they don’t know how to kitesurf. The pump is included with “Full Gear” and “Kite+ bar” Rentals. In case participants rent the gear but do not have the required skills to handle such gear, DKW center can cancel the gear rental contract at any time without refunding the rental charge.
7.3 Participants should report, upon returning the gear, any damages that may have been caused during their kiteboarding session. We require a non-refundable deposit of 40 Euros for gear maintenance and damages whose charges do not exceed 40 Euros. The participant or renter is liable for any damage whose estimate exceeds 40 euros. Damages and replacement costs are as follow: Kites: Severe deterioration or break, loss or theft will incur a charge of €1100, as a replacement cost to Dakhla Kitesurf World and that applies to any kind of kite. After payment of € 1100, the deteriorated leased kite belongs to the renter. Tears over 50 cm big or severe deterioration of leading edge will be considered as broken kite. Kites: Partial deterioration like pinholes, break of bridle lines, small tears, loss of valve cap etc. The renter will pay the repair costs. Bars: Severe deterioration or break, loss, or theft will incur an extra charge €400 for any bar type. The renter will pay the repair costs if the bar has like line stretch, broken lines, broken donkey sticks etc. Boards: Severe deterioration or break, loss, or theft will incur an extra charge €400 for any board type. The renter will pay the repair costs if the bar have wholes, bumps, loss of the fin, broken pads, lost screws…

8. The Hotel's Liability

8.1 Nothing in these Conditions purports to limit or exclude Dakhla kitesurf World’s liability for:
(a) death or personal injury caused by the negligence of its employees, subcontractors or agents;
(b) fraud or fraudulent misrepresentation; or
(c) any other matter for which it would be illegal for the Hotel to limit or exclude its liability.
8.2 If Dakhla Kitesurf World breaches these Conditions or is negligent, it is responsible for the loss of damage suffered by the Customer that is a foreseeable result of the breach of negligence but are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Dakhla Kitesurf World’s breach of these Conditions or if they were contemplated by Dakhla Kitesurf World and the Customer when they entered into the Contract.
8.3 The Customer agrees that Dakhla Kitesurf World is only supplying its facilities, products and services to the Customer for private use and have no liability to the Customer for any loss of profit, loss of business, business interruption or loss of business opportunity.

9. Other

9.1 The personal data collected by Dakhla Kitesurf World in the booking process is solely used for the purpose and performance of the Contract and will not be sold to third parties.
9.2 Dakhla Kitesurf World may, from time to time, change these Conditions without notice. However, the version of these Conditions in force at the time of the Booking will continue to apply to the Contract. Customers are advised to check dakhlakiteworld.ma for the latest version of these Conditions before making a Booking.
9.3 This Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the local business court having jurisdiction to deal with any disputes.
